Gild Terms of Service
Please read these Terms of Service ("Terms") carefully before using the Gild mobile application (the "App"), operated by Gild LLC ("Gild," "we," "us," or "our").
By downloading, accessing, or using the App, you agree to be bound by these Terms. If you do not agree, do not use the App.
1. Description of Service
Gild is a credit card rewards optimization app. The App helps you track your credit cards, understand their reward categories, and receive recommendations on which card to use for a given purchase based on your location ("Quick Pay"). Gild offers:
- Free features: card catalog browsing, manual card entry, Quick Pay recommendations, and the Wallet tab.
- Gild One (paid subscription): linked financial account tracking (via Plaid), goal tracking, and Secretariat, our AI-powered concierge chat feature.
Beta Disclaimer: The App is currently distributed through Apple's TestFlight beta program. Beta software may contain bugs, incomplete features, or behave unexpectedly. Financial-account linking during this beta period uses sandbox/test data only and does not connect to real financial institutions.
2. Eligibility
You must be at least 18 years old (or the age of majority in your jurisdiction) and capable of forming a binding contract to use Gild. By using the App, you represent that you meet these requirements.
3. Not Financial Advice
Gild provides informational recommendations about credit card rewards based on publicly available program terms and data you provide. Gild is not a financial advisor, and nothing in the App constitutes financial, legal, or tax advice. Reward program terms, point valuations, and card benefits are set by the respective card issuers and are subject to change without notice; we are not responsible for inaccuracies in third-party reward program terms. You should independently verify reward details with your card issuer before making financial decisions.
4. Account Registration
You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. Notify us immediately at support@gildwallet.com if you suspect unauthorized access to your account.
5. Subscriptions and Billing (Gild One)
- Gild One is billed through Apple's App Store using StoreKit. All billing terms, including auto-renewal, cancellation, and refunds, are governed by Apple's standard App Store subscription terms.
- Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current billing period, in accordance with Apple's policies.
- You can manage or cancel your subscription through your Apple ID account settings.
- Any free trial period will be clearly disclosed at the time of signup; if you do not cancel before the trial ends, you will be charged for the subscription.
6. Linked Financial Accounts
If you link a financial account through Plaid (Gild One subscribers only), you authorize Gild to access account and transaction data necessary to calculate your rewards and track your goals, in accordance with our Privacy Policy and Plaid's terms. You are responsible for ensuring you have the right to link any account you connect.
7. Secretariat (AI Concierge)
Secretariat uses Google's Vertex AI (Gemini) to generate responses based on your card data, goals, and chat history. AI-generated responses may be inaccurate or incomplete. Do not rely on Secretariat as your sole source of financial guidance. See our Privacy Policy for details on what data is shared with the AI model.
8. Location Data
Quick Pay requires location access to function. By enabling location permissions, you consent to Gild's use of your location as described in our Privacy Policy. You may disable location access at any time, which will limit Quick Pay's functionality.
9. Acceptable Use
You agree not to:
- Use the App for any unlawful purpose.
- Attempt to reverse-engineer, decompile, or extract the App's underlying algorithms or source code.
- Interfere with or disrupt the App's servers or infrastructure.
- Use automated means (bots, scrapers) to access the App without our written permission.
- Misrepresent your identity or provide false information when creating an account.
10. Intellectual Property
The App, including its design, logos, text, graphics, and underlying technology (including our card-recommendation methodology), is owned by Gild LLC and protected by intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the App for personal, non-commercial purposes. All rights not expressly granted are reserved.
11. Third-Party Services
The App integrates with third-party services, including Apple (StoreKit, push notifications), Plaid (financial account linking), and Google Cloud/Vertex AI (hosting, Secretariat). Your use of these integrations may be subject to those providers' own terms of service, which we encourage you to review.
12. Disclaimers
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. GILD DOES NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT CARD RECOMMENDATIONS WILL ALWAYS BE ACCURATE OR OPTIMAL.
13. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, GILD LLC AND ITS OFFICERS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE APP, INCLUDING ANY RELIANCE ON CARD RECOMMENDATIONS OR AI-GENERATED CONTENT FROM SECRETARIAT. OUR TOTAL LIABILITY FOR ANY CLAIM RELATED TO THE APP SHALL NOT EXCEED THE AMOUNT YOU PAID US (IF ANY) IN THE 12 MONTHS PRECEDING THE CLAIM.
14. Termination
We may suspend or terminate your access to the App at any time, with or without notice, for conduct that violates these Terms or is otherwise harmful to Gild or other users. You may stop using the App and delete your account at any time by contacting support@gildwallet.com.
15. Changes to These Terms
We may update these Terms from time to time. Material changes will be communicated via an in-app notice or by updating the "Last Updated" date above. Continued use of the App after changes take effect constitutes acceptance of the revised Terms.
16. Governing Law
These Terms are governed by the laws of the State of Georgia, without regard to its conflict-of-law provisions, unless otherwise required by applicable consumer protection law in your jurisdiction.
